Term & Conditions:
As used herein, the following terms shall have the following meanings:
Owner: The holder of record title to the Residence, and any officer, director, shareholder, member, employee or agent of such party.
Residence: The residential dwelling unit identified above for occupancy, or, if different, the residential dwelling unit in fact occupied by Guest pursuant to this Agreement.
Manager: Arena Fly, Arch Cabo Luxury Rentals, and any officer, director, shareholder, member, employee or agent of such party.
Guest: The party signing this Agreement for rental of the Residence

Cancellation policy: Bookings cancelled at least 60 days before the start of the stay will receive a 100% refund. Booking passing the 60 days are no refundable.

COVID policy: Reservation may be rescheduled at any time at the clients’ request if Destination is impacted by travel restrictions due to Covid-19. Full refund only in case Mexican government prohibit entry to the country or United States government prohibit exit to their country.

Damage Deposit: You are responsible for damages to the rental caused by you or your guests and agree to provide a credit card number for a hold as damage deposit; less any charges, is returned within 10 (ten) business days of the departure inspection.

Excessive Damages/ Security deposits: We understand that damage deposit can be used to pay for damages or excessive cleaning. This rental is including light cleaning but if the house requires heavy cleaning, you will be charged extra. Heavy cleaning is for example, when wiping down hardwood floors it is not good enough and it needs a professional cleaning due to spills and or damage. However, the guest is fully liable for any malicious damage, damage due to gross neglect or misuse of the property, and/or need for excessive cleaning. Costs incurred for the repair or cleaning of any such abuse to the property, will be the paid by the guests. Security deposits are refunded per the terms of the damage deposit refund policy.

Property Inspection: When guests vacate the residence at the end of the rental term, they will leave the residence in the same condition it was upon arrival. Guest should contact immediately their designated concierge if they notice upon arrival or during their stay, any conditions by the misuse. Also, contact your designated concierge directly within 24 hours of any maintenance items that arise during your stay.

Rules & Regulations

Check in: Available after 3:00 pm or earlier if confirmed by booking agent.
Check out: 11:00 am unless previously confirmed. Late check-out fees may apply depending on other guest arriving to the Residence the same day.

Your Personal Host will contact you after the reservation is confirmed to assist with trip pre-planning you may require; will greet you at the residence for your arrival, it will also be your point of contact if you need anything arise during your stay.

Housekeeping (Cleaning): Housekeeping service has an extra fee of $80.00 usd and will be offered every other day during your stay. The hours of this service can be coordinated with your Personal Host.

Lost or Stolen Items: The Owners are not responsible for any personal items which may
be lost or stolen during your stay. There is a safe provided.

Telephone and Wireless Internet:
The password for the Residence Wi-Fi will be provided at check-in.
There is a local Mexican phone line for local calls. The phone will be provided at the check-in (this is not set up for long distance calling)
Parking: There are parking spaces for vehicles on property if you choose to rent a car.


Pets are not allowed.

No Parties are allowed: this is a family Villa, and the furniture is not designed for parties. Parties are strictly prohibited. In case of omission of this rule, Arch Cabo Rentals has complete freedom to apply greater sanctions to the renters up to their eviction without the right to reimbursement.

Quiet Hours: The quiet hours are between 9:00 pm and 9:00 am.

Overnight guests are restricted to those names confirmed with this reservation. If the allowable guest-count is exceeded without express written permission, an additional fee of $2000.00 US dollars per person per night will be charged to discourage inappropriate use of the property.
Waiver of Liability: Arch Cabo Luxury Rentals and its staff act only as agents for the Owner. Owner and Pisces Luxury Villa Collection neither shall be liable for any claims, losses, damages, cost of expenses derived from the use of the Residence. The Guest hereby releases the Owner, Arch Cabo Luxury Rentals, its employees, representatives or agents for injury, loss or damage arising out of from the use of the Residence. The Guest also agrees to indemnify and defend the Owner, Arch Cabo Luxury Rentals, its employees, representatives, or agents against all claims, causes of action, damages, judgments, cost or expenses, including attorney fees and other litigation costs, which may in any way arise from the Guest use of the Residence premises.
Applicable Law: This Agreement is governed by the laws of the State of Baja California Sur, and the parties expressly submit any claim or controversy arising directly or indirectly from or related to it to the corresponding tribunals of Cabo San Lucas, Baja California Sur, expressly waiving any other jurisdiction to which the parties may be subject by virtue of its present or future domicile or otherwise.

All parties acknowledge that this agreement may be transmitted between them by fax machine or e-mail and the parties intend that a faxed or e-mail containing either the original and/or copies of the parties’ signature shall constitute a binding agreement.
Each adult guest who intends to occupy the Residence has read and fully understands this Rental agreement. Other than the guests registered above will be guests at the Residence. Agreement to the above terms also applies to the minor’s guardian will sign on their behalf.

*Minimum Age Limit for Renters is 25 years

In signing this Agreement, the Guest (s) does promise to abide with all Terms, Rules and Regulations contained herein.
*Attached to the signed agreement a scanned copy of the valid ID of the signing party.

I therefore accept fully responsibility for the well-being of my guests and will caution those in my party to take care when using the Residence premises,

Terms and Conditions
Cancellations or early departure does not warrant any refund. Renter and their guests must abide by all terms and conditions to avoid loss of rent if asked to vacate the property.
1. All guests must be registered, no exceptions, any un-registered guests will not be permitted on the property.
2. This is a non-smoking residence, please ask concierge for designated smoking areas, to avoid added charges for smoke smell in residences.
3. No pets allowed in residence.
4. The pool and hot tub are not fenced, and there is no lifeguard. Guests may use pool and hot tub at own risk.
5. Maximum occupancy of residence is 8, unless otherwise agreed upon in writing.
6. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in.
7. If guests fail to vacate the residence at the end of the specified use period, such permitted User may be subject to disciplinary action, monetary penalties, or both.
8. Quiet time is 10 PM. Any loud disturbances may result in expulsion from property, and loss of rental fee. Guests may contact concierge if there is a noise disturbance.
9. Renter is solely responsible for any damage or loss to the residence, furnishings, or the resort property caused by Renter, his family or guests; charges for food, beverages, transportation, tours, entertainment, telephone, spa and other services; tips and gratuities; fees and incidental expenses.
10. Upon arrival, Renter shall provide a valid credit card to Hacienda for payment of all charges, fees and expenses.
11. Owner shall not be liable to Renter, his family, or guests for any injury, illness, damage or loss to person, or personal other property, that may result from any reason, including but not limited to: occupying and using the Residence; including the pool and hot tub. Owner shall not be liable for any damages of any kind or nature, including consequential or punitive damages. The sole extent of Owner’s liability, if any, to the Renter shall not exceed the rental fee paid. The Renter and each family member and guest, on behalf of himself/herself (and their personal representatives, executors, administrators, agent and assigns) hereby agree to indemnify, defend, release and discharge Owner, his heirs, executors, administrator and assigns, from any and all claims or causes of action (known or unknown) arising out of Renter’s stay at Hacienda, the accommodations, transportation services, or any other reason. Renter agrees that any dispute or claim by Renter against Owner shall be brought in the appropriate court in the Cabo San Lucas, BCS, Mexico, and the prevailing party shall be entitled to an award of court cost’s and attorneys’ fees.

12. Hurricane or Storm policy: No refunds will be given unless: a. The National Weather Service orders a mandatory evacuation in
a “Tropical Storm/ Hurricane Warning area” and /or
b. A “mandatory evacuation order has been given for the Tropical Storm/ Hurricane Warning” area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation in a “Tropical Storm/ Hurricane Warning area”, we will refund: Any unused portion of rent from a guest currently registered, or any rent from a guest that is scheduled to arrive, as this would warrant a cancellation.
13. Renter and guests are not allowed to disturb the peace or cause annoyances to other guests at Hacienda.
14. Pool hours are from 7am-10pm. Poolside services vary depending on season.
15. No small external speakers allowed at the pool area, any listening devices must be used with headphones.
16. All children in the Beach Club area must be accompanied by an adult.
17. During the months of June, July and August, there may be renovations or maintenance of properties and common areas. Work is only permitted from 9am to 5pm. There may be some noise associated with the maintenance and/or disruption of some services.
18. Owner is not liable for any noise disruptions caused by external sources outside of Hacienda property.
19. No parties are allowed in the villa

Términos y condiciones

Las cancelaciones o salidas anticipadas no garantizan ningún reembolso. El arrendatario y sus invitados deben cumplir con todos los términos y condiciones para evitar la pérdida del alquiler si se les solicita que desalojen la propiedad.
1. Todos los huéspedes deben estar registrados, sin excepciones, no se permitirá la entrada a la propiedad a ningún huésped no registrado.
2. Esta es una residencia para no fumadores, solicite al conserje las áreas designadas para fumadores, para evitar cargos adicionales por olor a humo en las residencias.
3. No se permiten mascotas en la residencia.
4. La piscina y el jacuzzi no están vallados y no hay salvavidas. Los huéspedes pueden utilizar la piscina y la bañera de hidromasaje bajo su propia responsabilidad.
5. La ocupación máxima de la residencia es de 6 personas, a menos que se acuerde lo contrario por escrito.
6. Cualquier reservación obtenida bajo un pretexto falso estará sujeta a la pérdida del pago por adelantado, depósito y / o dinero del alquiler, y no se permitirá que la parte se registre.
7. Si los invitados no abandonan la residencia al final del período de uso especificado, dicho Usuario autorizado puede estar sujeto a medidas disciplinarias, sanciones monetarias o ambas.
8. El tiempo de silencio es a las 10 PM. Cualquier disturbio fuerte puede resultar en la expulsión de la propiedad y la pérdida de la tarifa de alquiler. Los huéspedes pueden ponerse en contacto con el conserje si hay alguna molestia por ruido.
9. El Arrendatario es el único responsable de cualquier daño o pérdida a la residencia, el mobiliario o la propiedad del resort causados por el Arrendatario, su familia o invitados; cargos por alimentos, bebidas, transporte, excursiones, entretenimiento, teléfono, spa y otros servicios; propinas y gratificaciones; honorarios y gastos incidentales.
10. A su llegada, el Arrendatario deberá proporcionar una tarjeta de crédito válida a Hacienda para el pago de todos los cargos, tarifas y gastos.
11. El propietario no será responsable ante el Arrendatario, su familia o invitados por cualquier lesión, enfermedad, daño o pérdida a una persona u otra propiedad personal, que pueda resultar de cualquier motivo, incluyendo pero no limitado a: ocupar y usar la Residencia ; incluyendo la piscina y el jacuzzi. El propietario no será responsable de ningún daño de ningún tipo o naturaleza, incluidos los daños consecuentes o punitivos. El único alcance de la responsabilidad del Propietario, si corresponde, al Arrendatario no excederá la tarifa de alquiler pagada. El Arrendatario y cada miembro de la familia e invitado, en su nombre (y sus representantes personales, albaceas, administradores, agentes y cesionarios) acuerdan indemnizar, defender, liberar y despedir al Propietario, sus herederos, albaceas, administrador y cesionarios, de todos y cada uno de los reclamos o causas de acción (conocidas o desconocidas) que surjan de la estadía del Arrendatario en Hacienda, el alojamiento, los servicios de transporte o cualquier otra razón. El Arrendatario acepta que cualquier disputa o reclamo del Arrendatario contra el Propietario se presentará en el tribunal correspondiente en Cabo San Lucas, BCS, México, y la parte vencedora tendrá derecho a una adjudicación de los costos judiciales y los honorarios de los abogados.
12. Política de huracanes o tormentas: No se otorgarán reembolsos a menos que: a. El Servicio Meteorológico Nacional ordena una evacuación obligatoria en
un "Área de advertencia de tormenta tropical / huracán" y / o
B. Se ha emitido una “orden de evacuación obligatoria para el área de residencia de tormenta tropical / advertencia de huracán” de un huésped de vacaciones. El día en que el Servicio Meteorológico Nacional ordene una evacuación obligatoria en un "Área de advertencia de tormenta tropical / huracán", le reembolsaremos: Cualquier parte no utilizada del alquiler de un huésped actualmente registrado o cualquier alquiler de un huésped que esté programado para llegar, según esto justificaría una cancelación.
13. El arrendatario y los invitados no pueden perturbar la paz o causar molestias a otros huéspedes en Hacienda.
14. El horario de la piscina es de 7 am a 10 pm. Los servicios junto a la piscina varían según la temporada.
15. No se permiten pequeños parlantes externos en el área de la piscina, cualquier dispositivo de escucha debe usarse con auriculares.
16. Todos los niños en el área del Beach Club deben estar acompañados por un adulto.
17. Durante los meses de junio, julio y agosto, puede haber renovaciones o mantenimiento de propiedades y áreas comunes. Solo se permite trabajar de 9:00 a 17:00 horas. Puede haber algo de ruido asociado con el mantenimiento y / o interrupción de algunos servicios.
18. El propietario no es responsable de las interrupciones por ruido causadas por fuentes externas fuera de la propiedad de Hacienda.
