Arch Cabo Rentals offers flexible rescheduling and cancellation on new reservations. With this policy in place, you can rest easy knowing that if anything comes up, you can reschedule or cancel your vacation without any penalties on select homes.

The Guest And Other Registered Guests

You must be a minimum of 25 years old to sign a lease. Kids are welcome at all properties.

If you rent a property through Arch Cabo Rentals, you will be responsible for the property during your stay. You will also be liable for any damage to the property or violations of house rules, as well as any fines or penalties.

The Guest agrees that they will only have the number of people who are on the reservation at the property for the duration of the rental. Unauthorized invitees will result in extra charges, event fees and/or other assessments.

Please notify us if your guest count changes so we can prepare the house for your arrival. There are no exceptions or refunds for a different number of people after your arrival.

Guest Expected Conduct

Excessive noise, loud music, illegal activity, or destruction of rental property will result in eviction.

When attending our properties, guests are expected to behave in a polite manner that is considerate of others. Guests are expected to leave the property in its original condition. Guests are liable for any fines resulting from violations of these policies.

Your Arrival And Check-In

Guest Check-In is at 3pm.

Arch Cabo Rentals may be able to accommodate early check-ins depending on the timing of previous renters.

If you need to arrive before the stated check-in time, contact Arch Cabo at least three days prior to arrival so they can schedule the cleaning of the property. Note that this service is not guaranteed until three days prior to your arrival.

While early check-ins can’t be guaranteed, you can drop off your bags if the housekeeping staff is already there.

Arch Cabo Luxury Rentals has a concierge. You can schedule your arrival time with your concierge and take a tour and inspection of the property. If you find anything damaged, please take pictures and submit them to our customer service department.

Your Departure

Guest Check-Out is at 11am.

Upon check-out, the rental unit should be returned in the same condition as when you checked in.

Please confirm your departure time with your Personal Concierge. If you would like a late check-out, you must confirm in writing with Arch Cabo, and that depends on availability. We charge $125 USD per hour for any stay past 12:00PM. Any Stay past 3:00PM will be charged as an additional rental night.

Payments

To confirm a booking, you must pay 50% (fifty percent) of the total reservation amount by wire or card. You will then have up to 45 days, depending on the rental unit to complete payment of the balance. Please see the rental agreement or ask us for details.

Please note that by making a reservation, you agree to pay in full 15 days prior to.

Accidental Damage Waiver Security Deposit

A damage deposit will be required on all reservations. This will be processed by credit card pre-authorization approximately 7 days prior to your scheduled check-in date. We will also accept a bank wire, which will be refunded after checkout, less any damages.

Arch Cabo Rentals offers a walk-through inspection at check-in and checkout with an Arch Cabo representative. At check-in, any damages or missing items will be noted and acknowledged with signature by Guest.

Deposit will be held for up to 10-days (ten) following departure in order for Arch Cabo to detect any additional damages that were not noticed during the check-out walk-thru inspection.

We will withhold your security deposit for the time necessary to clean and repair any damage you cause, but we will provide receipts for materials and workers’ compensation if extra care is needed.

As a guest, you are responsible for any damage that might happen to the property, lost property, expensive cleaning required, HOA fines, event fees, excess occupancy fees, labor needed to repair delivery damages, and/or service charges during the occupancy.

In the event that any damage to the property is not covered by the Accidental Damage Waiver and exceeds the amount of the security deposit, Guest personally guarantees that he/she will pay Arch Cabo for said damages within 14 days from Arch Cabo sending a payment request.

Arch Cabo Rentals reserves the right to charge your credit card for any and all uncovered losses and damages sustained to the rental property.

If there are no damages or missing items to/in the vacation rental property, we will return your entire security deposit.​​​​​

Travel Insurance

Arch Cabo provides and recommends travel insurance for most reservations (inquire for restrictions). Premium Travel Insurance is available up to 14 days after your initial booking.

Standard Travel Insurance is available for 7% of the reservation total, up to 30 days before your scheduled check-in. If your reservation is within 30 days of check-in, travel insurance must be bought at the time of booking.

Rescheduling Reservations

We will allow Guests to reschedule their travel dates without penalty, up to 15-days (fifteen) prior to arrival, if unable to travel due to COVID-19 (i.e. border closures, travel bans, majority of traveling party has positive COVID tests within 30-days of your arrival)

We’ll hold your credit for future dates. You can redeem it up to 1 year from your original travel dates, at the same property and for the same number of nights (you’re able to extend your stay based on availability).

You are permitted to reschedule your vacation without penalty or fees only once. Rescheduled vacations are subject to rate increases, based on availability and season. This offer is NOT valid for vacation dates between December 16th and January 5th.

We’re not willing to reschedule your trip due to your concern about traveling. If you reschedule, we’ll try to re-rent your trip. If we can re-rent it, you’ll be credited for future travel minus a 15% rescheduling fee.

Cancellations

There are NO cancellations. In the event the rental property is rendered unfit for occupancy or use, this Agreement may be terminated by Arch Cabo and you will be provided a full or pro-rated refund for the time the rental property was not used.

If you cancel your vacation, we’ll try to rebook the dates. If the dates are fully booked, we’ll refund you minus a rescheduling fee. If someone else books your dates, we have to approve them before accepting their reservation.

Arch Cabo Rentals is a vacation rental service that allows travelers to pay for a guaranteed reservation at a rental property. All of the properties on Arch Cabo Rentals are pre-screened by the company.

The Guest is renting a resort home through Owner/Provider. Vacation properties are unique, so please confirm all the details of the property before booking. The home will be unavailable for rental to other guests while it’s being rented by Guest.

If you need to cancel your reservation and are eligible for a refund, the money will be returned in the same method in which it was received. If you paid by credit card, the 4% merchant processing fee will not be returned and an additional cancellation fee will be assessed.

Arch Cabo Rentals offers travel insurance options at booking and these remain available up until 30 days before arrival.

Outside Vendors And Other Services

Arch Cabo offers full-service assistance to all guests through a Personal Concierge. Only providers, outside agencies and services offered through Arch Cabo are permitted on the premises at any time.

The Guest agrees not to contract with a third party for any services provided by Arch Cabo without first consulting with Arch Cabo and obtaining written consent.

Smoking

Smoking is not permitted inside the rentable property. A $500 fine will be issued if smoking is detected. One warning will be given. Eviction will follow the second offense.

Pets In The Rentals Unit

Unless you get written approval from Arch Cabo, you cannot bring a pet on premise. You will be charged $750 USD if you violate the rules.

Private Property

Due to the unique nature of the property, you consent to any locked off areas being exclusively reserved for the owner. You will not make any alterations, repairs, modifications to any part of the property at any time.

The apartment may be inside a gated community, and the facilities are private. Some of the facilities are accessible for a fee, and arrangements can be made through the Personal Concierge.

Unless otherwise stated in the property’s listing, there is no access to private areas. Using unauthorized facilities and areas can be considered trespassing.

Community Rules

Guest acknowledges that he/she is subject to rules within the community in which he/she is staying. If there are any violations, Guest will be held responsible for them. Guest will act in a socially respectable manner within the community and in all clubs within the development.

Arch Cabo Rentals requires you to subscribe to its policies before using drones on Arch Cabo properties. Other communities assess fines, police, and Guest removal from property due to the unauthorized use of drones.

Plumbing Issues

Plungers are provided on the properties in case of a clog. Please understand that Mexican sewage systems are more sensitive than others. Do not pour grease or other foreign objects (such as feminine products) in drains or toilets. Any plumbing issues will require a minimum deduction of $50 USD from the security deposit.

Emergencies And Maintenance Plumbing Issues

If there is an emergency, dial 911.

If you sense any maintenance issues, please report them immediately to Arch Cabo Property Management.

Arch Cabo is a 24/7 service company and we will take care of issues in a timely manner to avoid any discomfort during your stay.

Arch Cabo Right Of Entry

Arch Cabo may enter the Property as follows:

  • With guest consent;
  • If the guest is unreasonably withholding consent;
  • If necessary for protection of rental property;
  • In the event that repairs or maintenance of the property is necessary;
  • In the event of an emergency;
  • If the guest is unreasonably
  • at any time for protection of the Property

Security And Acknowledgement Of Safety Risks

When you book a vacation rental, make sure to lock the doors and windows when you leave. You should take responsibility for the property and its contents while you’re using it. Arch Cabo will not be responsible for any injuries or theft that happens due to Guest’s failure to use caution.

It is important that children in this community are supervised at all times and especially when in the pool area.

Please use extra caution with gas appliances, fire features, and water features. If you do not know how to use the facilities properly, call Arch Cabo (US: +52 (624) 154-9659.)

Guests must supervise the activities on the Property including but not limited to activity in or near the pool. Please note that the vacation rental property Owner does not provide a lifeguard on the property or any common elements that may be used by the Guest.

Guests need to be aware of the following risks: that the house has very slippery floors when wet, paths can lead to steep drop-offs, unfenced pools may have steep drop-offs, and other dangers that are not listed.

The dangers listed below are not all-inclusive, but they exist. Therefore, you agree that you’re voluntarily participating in this activity, and you accept all the risks including: injury, illness, loss of life and damage or loss of property that could result.

The Guest's Personal Property

Arch Cabo are not responsible for damage, theft, or losses to your belongings while you stay there. If you leave something behind, Arch Cabo is under no obligation to return it to you.

Arch Cabo may return items to the Guest but note it has a policy of sending items left behind by Guests or a member of a Guest’s party back to the Guest, both at the Guest’s request and at the Guest’s expense.

In Case Of Construction And Utilities Disruption

The Guest accepts the following factors that may affect the peaceful use of this Villa:

  • We do our best to keep the area quiet and peaceful. However, there may be construction nearby that may affect noise or temporary disruption of utility services. Construction hours vary per community you’re staying in.

Indemnification And Hold Harmless

As a guest, you and your invitees use the vacation property and its contents (including hot tubs and BBQs) at your own risk. Arch Cabo Rentals, the homeowner, and other related entities are not responsible if you sustain any injuries during your stay at the rental property

The guest will agree to indemnify and hold the homeowner, Arch Cabo Rentals, or any affiliate provider, Agents, the Development and its employees harmless.

If a lawsuit occurs as a result of you, your guests or invitees injuring themselves, you must pay for all costs and expenses and reasonable attorney fees.

Credit Card Authorization And Acknowledgment

The Guest signing the Agreement has authorized Arch Cabo to charge his/her credit card for vacation related expenses incurred by his/her party during the reservation dates.

Arch Cabo Rentals will charge your credit card for any damage to the property that is not covered by the Accidental Damage Waiver.

If you file a credit card dispute, and this dispute ends in the favor of Arch Cabo, Arch Cabo Rentals will apply a 50% “reservation fee” to the disputed amount. This will cover labor, attorney’s expenses, and the risk of losing your merchant account, which would lead to losing future business.

Miscellaneous Items

  • It is best that all questions and concerns are brought to the attention of Arch Cabo Rentals in a timely manner.
  • This contract is governed by the laws of Baja California Sur, Mexico. Any dispute that arises out of or in connection with this agreement shall be resolved exclusively in the courts located in Cabo San Lucas, Baja California Sur, Mexico.
  • In the event that any provision of this agreement is found to be invalid, the remaining provisions shall continue in full force and effect.
  • Any signature delivered by digital signing shall be treated in all manner and respect as an original document.
  • The Guest is signing The Agreement in good faith.
  • This contract embodies the entire agreement and the understanding between and among the parties relating to the subject matter hereof, and supersedes all prior proposals, negotiations, or prior understandings relating to such subject matter. The only modifications, amendments, or waivers shall be obtained in writing prior to The Guest’s arrival.
  • The Guest acknowledges that if a request for a particular item or service made by the Guest is not put in writing, prior to arrival, then Guest will have no legal right to request that item or service be provided and will have no legal right to reimbursement for said item or service.
  • If the Guest decides to vacate a rental property before the end of the agreed upon rental period for any reason, the guest will not receive compensation for time not used.
